Terms of Service

Sightline Softball (sightlinesoftball.com) is part of Sightline Baseball. Everything below applies to it the same way: wherever it says Sightline Baseball, sightlinebaseball.com or baseball, read it as covering softball too.

These Terms of Service ("Terms") constitute a legally binding agreement between you and Sightline Baseball ("Sightline," "we," "us," or "our") governing your access to and use of the website, applications, and services offered at sightlinebaseball.com (collectively, the "Service"). By accessing or using the Service, creating an account, or clicking to accept these Terms, you agree to be bound by them. If you do not agree, do not use the Service.

1. Eligibility and Account Registration

The Service is intended for baseball players in high school and older, their families, coaches, and college scouts. You must be at least 13 years old to create an account or to submit personal information through any part of the Service, including a coach's self-report link. If you are between 13 and 17 years of age, you may only use the Service with the involvement, consent, and supervision of a parent or legal guardian, which you confirm at signup or at the point of submission (see the Privacy Policy, Section 4).

By creating an account, you represent and warrant that: (a) all information you provide is accurate, current, and complete; (b) you are legally capable of entering into a binding contract, or if you are a minor, that your parent or guardian has consented to your use of the Service and these Terms on your behalf; (c) you will maintain the accuracy of your information; and (d) your use of the Service does not violate any applicable law or regulation.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

2. Nature of the Service

Sightline Baseball provides a software tool for organizing baseball player information, generating shareable recruiting profiles, and enabling coaches and scouts to track prospects. Sightline is not a recruiting service, athletic scholarship advisor, educational placement service, or financial, valuation, tax, or legal advisor. We do not guarantee, promise, or represent that use of the Service will result in any recruitment, scholarship, roster spot, evaluation, or any other outcome. Any information provided through the Service is for informational purposes only.

3. User Content

You retain ownership of all information, images, statistics, notes, and other content you submit to the Service ("User Content"). By submitting User Content, you grant Sightline a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, process, and transmit that content solely as necessary to operate, provide, and improve the Service.

You represent and warrant that: (a) you own or have all necessary rights to submit the User Content; (b) the User Content does not infringe any third party's intellectual property, publicity, privacy, or other rights; (c) the User Content is truthful and not misleading; and (d) the User Content complies with all applicable laws and these Terms.

You are solely responsible for your User Content and the consequences of submitting it. Sightline does not endorse, verify, or vouch for the accuracy of any User Content.

4. Sightline's Intellectual Property

Apart from User Content, the Service and everything in it — including the software, source code, database structure, valuation and analytics models and their underlying methodology, screens, layouts, graphics, text, reports, compiled reference and benchmark datasets, and the "Sightline Baseball" name and logo — is owned by Sightline or its licensors and is protected by copyright, trademark, trade secret, and other intellectual property laws. No rights are granted to you except those expressly stated in these Terms.

Subject to your compliance with these Terms (including payment of any applicable fees), Sightline grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your own personal or internal program use. You may not copy, modify, adapt, translate, create derivative works from, publicly display, distribute, sell, license, or otherwise exploit any part of the Service, nor remove or obscure any proprietary notice, except as expressly permitted here or by applicable law that cannot be contractually waived.

You may export, print, and use reports and data generated from your own account for your own recruiting purposes. This does not grant any right to redistribute the Service itself, to use it to build or train a competing product or model, or to use Sightline's name, logo, or branding without our prior written permission.

If you send us feedback, suggestions, or feature ideas, you grant Sightline an unrestricted, perpetual, irrevocable, royalty-free right to use and incorporate them without obligation or compensation to you.

5. Sharing and Public Content

The Service allows you to generate share links that make selected portions of a player's profile publicly accessible to anyone with the link. You are solely responsible for choosing to share links and for the consequences of sharing. Once information is shared via a public link, we cannot control how recipients use, save, distribute, or reproduce that information.

Scouts and coaches using the Service may import shared profiles into their prospect boards. Importing a profile does not transfer ownership; the player retains control over their profile data.

6. Coach Verification

The Service includes an optional Coach Verification feature that allows a coach to sign a printed report attesting to the accuracy of the information contained in it. Any such verification represents the personal attestation of the coach who signed it and does not constitute an endorsement, verification, or guarantee by Sightline. Sightline is not responsible for the accuracy or authenticity of any coach verification.

7. Acceptable Use

You agree not to: (a) violate any law, regulation, or third-party right; (b) submit false, misleading, fraudulent, or inaccurate information; (c) impersonate another person or misrepresent your affiliation with any player, coach, team, or organization; (d) use the Service to harass, threaten, abuse, or harm any person, particularly minors; (e) attempt to gain unauthorized access to the Service or other users' accounts; (f) reverse engineer, decompile, or attempt to derive the source code of the Service; (g) use automated means (bots, scrapers, crawlers) to access the Service without our written permission; (h) resell, redistribute, or commercially exploit the Service or its content without written permission; (i) upload viruses, malware, or other harmful code; or (j) use the Service for any purpose other than as expressly permitted by these Terms.

We reserve the right, but have no obligation, to monitor, review, or remove User Content, or to suspend or terminate accounts that we believe violate these Terms or applicable law, at our sole discretion and without notice.

8. Subscriptions, Trials, and Fees

Player accounts are currently offered without charge. Coach, scout, and program accounts are paid: new coach accounts receive a free trial (currently 14 days; length subject to change for future signups), during which no payment method is required and nothing is charged. When the trial ends, access to paid features is suspended until a subscription is started — your data is retained and nothing is ever charged automatically at the end of a trial.

Subscription pricing is quoted individually per program rather than published as a standard list price. The price presented to you at checkout is your agreed program rate. Subscriptions are billed annually in advance through our payment processor, Stripe, and RENEW AUTOMATICALLY at the end of each annual term at your then-current agreed rate, until cancelled. You can cancel at any time from your Billing page or by emailing us at the address shown there; cancellation takes effect at the end of your current paid term, and you keep access through that date. We will notify you in advance of any change to your program rate before it applies to a renewal.

Except where required by law, fees are non-refundable, including for partially used subscription periods. You are responsible for any applicable taxes. If a renewal payment fails or a subscription is cancelled through the payment processor, we may suspend access to paid features until payment is resolved; your data is retained during any such suspension in accordance with the Privacy Policy.

9. Termination

You may terminate your account at any time by contacting us at jeff@sightlinebaseball.com. We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, at our sole discretion. Upon termination: (a) your right to use the Service ceases immediately; (b) we will delete your account and associated User Content from active systems within 30 days, except as required to comply with legal obligations, resolve disputes, or enforce our agreements; and (c) sections of these Terms that by their nature should survive termination will survive, including sections on User Content licenses, disclaimers, limitation of liability, indemnification, and dispute resolution.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. SIGHTLINE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

SIGHTLINE MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING: (a) THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY USER CONTENT OR THIRD-PARTY CONTENT; (b) THE OUTCOMES OF ANY RECRUITING OR RELATED ACTIVITY; (c) THE CONDUCT OF ANY USER; OR (d) THE CONTENT, POLICIES, OR PRACTICES OF ANY THIRD-PARTY WEBSITE OR SERVICE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SIGHTLINE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, LOST DATA, LOST OPPORTUNITIES, OR EMOTIONAL DISTRESS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT SIGHTLINE HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN NO EVENT WILL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID TO SIGHTLINE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Sightline, its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any third-party right, including intellectual property, publicity, or privacy rights; or (e) your violation of any applicable law.

13. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Before filing any claim, you agree to first contact us at jeff@sightlinebaseball.com with a written description of the dispute and give us 30 days to try to resolve it informally. Most concerns can be resolved this way.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that is not resolved informally will be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in the English language and will take place in Washington State, or via videoconference at your election.

You may opt out of this arbitration provision by emailing jeff@sightlinebaseball.com within 30 days of first accepting these Terms, stating your name, account email, and that you decline to arbitrate. Opting out does not affect any other part of these Terms.

You and Sightline waive the right to a trial by jury and the right to participate in a class action, class-wide arbitration, or representative action. Claims must be brought in an individual capacity only.

Notwithstanding the above, either party may bring an individual claim in small claims court if the dispute qualifies. Claims for injunctive relief related to intellectual property may be brought in a court of competent jurisdiction.

If any part of this arbitration provision is found to be unenforceable, the remainder will continue to apply. If the class action waiver is found unenforceable, the entire arbitration provision will be void.

14. Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles. Except for claims subject to arbitration, any legal action must be brought exclusively in the state or federal courts located in Washington.

15. Changes to These Terms

We may update these Terms at any time. If we make material changes, we will provide prominent notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

16. Miscellaneous

These Terms, along with the Privacy Policy, constitute the entire agreement between you and Sightline regarding the Service. If any provision is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not be considered a waiver. You may not assign these Terms without our written consent; we may assign them freely. Notices to Sightline should be sent to jeff@sightlinebaseball.com.

17. NCAA Compliance Disclaimer

The Service provides informational summaries of publicly available NCAA recruiting rules and calendars (contact periods, quiet periods, dead periods, and class-year eligibility windows) to help you track recruiting activity. These summaries do not constitute compliance, legal, or eligibility advice of any kind.

You (including any coach, scout, or institutional staff member using the Service) are solely responsible for compliance with NCAA, conference, and institutional rules governing recruiting contact, evaluation, and eligibility. You should verify current rules and any specific situation with your institution's compliance office before acting on information shown in the Service.

Sightline makes no representation or warranty that use of the Service — including any compliance status, badge, or summary it displays — satisfies any NCAA, conference, or institutional requirement, and does not represent that any bylaw classification shown is definitive or current.

18. Valuation Estimates and Financial Tools

The Service includes tools that generate estimated player valuations, suggested budget allocations, market benchmark comparisons, cash-flow projections, and similar figures. These are informational modeling outputs computed from inputs you configure (such as your own program budget), data you or other users enter, and publicly available reference data. They are estimates, not appraisals, offers, promises of market value, or predictions of any actual transaction, and they do not constitute financial, investment, tax, or legal advice.

You (including any coach, program, or institution) are solely responsible for all scholarship, NIL, roster, and financial decisions, and for ensuring those decisions comply with NCAA rules, conference and institutional policies, and applicable state and federal law, including laws governing name, image, and likeness. Sightline makes no representation that any estimate shown in the Service reflects what any player is, will be, or should be paid.
